1. Introduction
EvaraTech is a cleantech startup building intelligent water management solutions using IoT, AI/ML, and data-driven analytics. We develop non-intrusive hardware devices and software platforms to monitor water levels, detect leakage, digitize analog meters, and provide actionable insights through AI-powered dashboards. Our mission is to enable sustainable, efficient, and scalable water resource management.
These Terms & Conditions (“Terms”) govern access to and use of the EvaraTech /
EvaraOne mobile application (Android package com.evaratech.evaratech),
related web application, and backend services (the “Service”) provided by
EVARATECH PRIVATE LIMITED (“EvaraTech”, “we”, “us”).
2. Acceptance of Terms
By creating or using an account, accessing the Service, or controlling connected devices through the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
3. User Accounts
- Accounts are typically issued or invited by an organization administrator.
- You must provide accurate information and keep credentials confidential.
- You are responsible for activity under your account.
- Notify us or your administrator promptly if you suspect unauthorized access.
4. User Responsibilities
- Use the Service only for lawful purposes and in accordance with your organization’s policies.
- Ensure only authorized personnel can open/close valves, start/stop motors, change thresholds, or push device configuration.
- Verify device state on-site when safety-critical work is performed.
- Maintain compatible phones, OS versions, and network connectivity needed for the app.
5. IoT Device Usage and Remote Control
The Service can monitor and remotely control physical equipment such as tanks, valves, flow meters, motors, and related sensors. Remote commands and configuration changes are transmitted over networks and depend on device firmware, MQTT/API connectivity, power, and local site conditions.
- You acknowledge that network outages, delayed messages, device fail-safe behavior, firmware bugs, or misconfiguration can cause unexpected device states (including valves opening/closing or motors changing state).
- You are responsible for designing safe physical installations, including local fail-safes, emergency stops, and procedures that do not rely solely on the mobile app.
- Do not use the Service as the sole safety system for life-critical or high-risk processes.
6. Internet and Network Dependency
Features including live telemetry, alerts, provisioning, and remote control require internet access and functioning cloud/device connectivity. We do not guarantee continuous availability of cellular, Wi‑Fi, MQTT, or third-party cloud services.
7. Service Availability
We strive to keep the Service available but may suspend, modify, or discontinue features for maintenance, security, legal, or operational reasons. Scheduled or emergency downtime may occur without prior notice when necessary to protect systems or users.
8. Third-Party Services
The Service relies on third parties such as Google Firebase and infrastructure providers. Your use of those components may be subject to their terms. EvaraTech is not responsible for third-party outages outside our reasonable control.
9. Intellectual Property
The app, branding, documentation, and software are owned by EvaraTech or its licensors. You receive a limited, non-exclusive, non-transferable license to use the Service as permitted by your organization and these Terms. You may not reverse engineer, copy, or resell the Service except as allowed by law.
10. Prohibited Activities
- Attempting to access devices, data, or accounts you are not authorized to use
- Interfering with Service security, MQTT brokers, APIs, or other customers’ systems
- Using the Service to cause harm, flooding, contamination risk, or unsafe equipment operation
- Uploading malware or abusing notification/alerting systems
11. Account Suspension and Termination
We or your organization administrator may suspend or terminate access if these Terms are violated, if fees/contract terms (if any) are not met, or if needed to protect the Service or other users. You may stop using the Service at any time. Account deletion instructions are available at Account deletion.
12. Warranty Disclaimer
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. 13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EVARATECH AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS INTERRUPTION, OR FOR PHYSICAL DAMAGE, WATER DAMAGE, EQUIPMENT DAMAGE, OR PERSONAL INJURY ARISING FROM RELIANCE ON THE SERVICE OR FROM REMOTE DEVICE CONTROL, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNTS PAID BY YOU (IF ANY) FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ONE HUNDRED USD IF NO FEES WERE PAID, UNLESS A MANDATORY LAW PROVIDES OTHERWISE.
